When a case is tried, in almost all situations the jury decides who is at fault of the accident. The jury is made up of six peers from your community who are chosen by both the defense and the plaintiff and they decide ultimately who is at fault. The decision is based on the facts produced by the attorneys through evidence introduced into the court during the trial session. The evidence could be by live witnesses, it could be demonstrative, but the jury is going to hear a lot of different elements of evidence and then they’re going to make the decision as to who was at fault for the particular accident in question.
