First of all, medical malpractice lawyers are not that common because it takes a lot of experience in order to be competent at trying a medical malpractice case. Not only do you have to understand the medicine and understand the applicable law, you also have to have the pocketbook to be able to fund these cases. These are very expensive cases to litigate. We have to hire expert witnesses, usually from out of state. We have to fly wherever they are to meet with them, conference them, take their depositions. We have to pay a lot of money for them to leave their practice to come to Florida to testify in your case.
Unless a lawyer has the funding to really be able to handle the case properly and the expertise, there aren’t many lawyers who have all of those things and are willing to take on these hard, hard cases.
