Why the uproar about the DePuy ASR hip replacement recall? It’s because in the United States alone, tens of thousands of people were given the ASR hip replacement system and recently DePuy has admitted of failure rates of 12% in their ASR system. DePuy Orthopaedics, Inc. has recently announced the voluntary recall of its ASR XL Acetabular System and DePuy ASR Hip Resurfacing System. David Floyd, President of DePuy Orthopaedics, released a statement regarding this recall, claiming: “We regret that this recall will be concerning for patients, their family members and surgeons. We are committed to assisting patients and health care providers by providing information through multiple channels and paying for the cost of doctor visits, tests and procedures associated with the recall.”
So how did this get by the FDA? When DePuy submitted the ASR system to the FDA they only had to show that its new medical device is “substantially similar” to other devices already on the market. DePuy made the claim its new ASR acetabular cup was “similar” to its prior cup, the DePuy Pinnacle device.
The crucial difference between the two is how they attach to the “hip”. The Pinnacle was designed to be fastened to the bone with screws, the ASR offered surgeons no means to fasten it to the patient’s bone. Its only means of fixation was for bone to grow around and into the device. As a result DePuy began marketing and selling the ASR. DePuy and Johnson & Johnson were never required to go through clinical trials or prove that the ASR was free of dangerous defects.
