One Fatality and Two Injured in Miami Beach Accident

Serious Miami Beach Car Crash Causes Fatality

On Thursday, a fatal car accident on MacArthur Causeway resulted in one fatality and two serious injuries. The car accident took place after a Lamborghini Aventador was spotted traveling at speeds in excess of 100 mph. The car was speeding at 3 a.m. and crashed into a Chevy Suburban that was stopped at a red light in Miami Beach.

Lamborghini Passenger Dies

The passenger of the Lamborghini, Dr. Malcolm Lloyd, died as a result of the impact of the crash. The driver of the crash, Andres Toro, may face charges for reckless driving. Authorities have stated that Mr. Toro could also face more serious charges depending on the results of pending alcohol and drug tests. Dr. Lloyd was the founder and CEO of Old Nassau Imports. Authorities also stated that Dr. Lloyd was the brother-in-law of Mr. Toro.

Asserting a Negligence Claim

The injured victim in the Chevy Suburban may have a negligence claim against the driver of the Lamborghini. A Miami auto injury lawyer may assist the driver in asserting a negligence claim against the responsible party.

Proving Negligence in Auto Accidents

The results of the other driver’s drug and alcohol tests could be revealing in this case. If the driver is shown to have been under the influence of drugs or alcohol at the time of the accident, then the injured victim may be able to assert a claim for punitive damages against the driver. In Florida, an injured victim may recover up to $500,000 or three times the compensatory damages award for punitive damages. One may assert a claim for punitive damages when the party causing the injuries has been grossly negligent or has shown a reckless disregard for the safety of others. In this case, an auto accident attorney may argue that the Lamborghini driver disregarded the safety of others in driving the vehicle as excessive speeds. If the man is found to have been under the influence of alcohol or drugs, then this may also factor into a punitive damages claim.
